3.6 billion lira competition fine from the Competition Board to some automotive tire manufacturers
The Competition Board imposed a fine of 3 billion 633 million 935 thousand 171 liras on automotive tire manufacturers and distributors.
In the statement made on the Competition Authority’s website, it was stated that, in accordance with the Board’s decision, the investigation into the allegation that undertakings operating in the field of tire production and distribution in the automotive industry violated the relevant article of the Law on the Protection of Competition was completed.
In the statement, it was stated that within the scope of the investigation, allegations of concerted action among competitors regarding price movements, exchange of competition-sensitive information, determination of resale prices of dealers, regional and customer restrictions for dealers, discrimination, non-competition obligation, exchange of information restricting competition regarding labor markets and not seducing employees were examined, and while the investigation continues, Abdulkadir Özcan Otom. It was stated that it was decided to impose a fine on Şti and to end the investigation with a conciliation procedure regarding these enterprises.
As a result of the investigation, the following information was given in the statement:
“Administrative fines were imposed on Aydın Lastik Sat. Therefore, it was decided that there was no need to impose administrative fines on the relevant undertakings due to the statute of limitations within the scope of the relevant article of the Misdemeanor Law, 497 million 91 thousand 986 liras as a result of the settlement and 3 billion 633 million 935 thousand liras as a result of the investigation. “An administrative fine of 171 lira was imposed.”
In the statement, it was stated that there was no need to impose administrative fines on Prometeon Turkey Industrial and Commercial Tires, Brisa Bridgestone Sabancı Lastik Sanayi ve Ticaret and Hankook Tires, and that it was decided that Brisa Bridgestone Sabancı Lastik Sanayi ve Ticaret AŞ would benefit from the group exemption within the scope of the Group Exemption Communiqué on Vertical Agreements in the Motor Vehicles Sector.
Limitation on indirect information sharing through dealer channels
In the statement, it was stated that commitments were made to the investigated producer and supplier undertakings operating in the tire renewal market in Türkiye in order to prevent indirect information exchange through dealers who are considered to have an impact on the occurrence of the concerted action determined to have taken place regarding price movements, to prevent the repetition of the relevant violation and to establish competition in the relevant market.
“A coding that will distinguish each dealer will be included in all kinds of announcements regarding the price list and price-related elements to be made to the dealers, with a distinctive, visible watermark method, spread over more than one page. The method of collectively transmitting these announcements to more than one dealer or to all dealers will be discontinued. Instead, these announcements will be made one-on-one through the interface/portal where transactions between the manufacturer and provider enterprise and their dealers take place, to which each dealer can access with his/her own username and password. Apart from the relevant interface and portal, verbal or any written method will not be used. If such an interface and portal does not already exist, this system will be created and made accessible to dealers, and will be prevented from transmitting information and announcements regarding prices and price elements with a future date or implementation date to rival manufacturers or dealers.
